Renting your flat to tourists in Jaén: what each municipality allows in 2026

In the province of Jaén only Úbeda sets conditions on tourist homes (parking and, in the historic centre, a separate entrance in blocks of flats). Jaén city, Baeza and Cazorla have no published municipal limits. Inland, check whether yours is a rural tourist home. With date and source.

In short: in the province of Jaén no town hall has suspended new tourist homes. Only Úbeda has set planning conditions, since 2022. In Jaén city, Baeza and Cazorla there is no published municipal limit (provincial gazette reviewed from December 2020 to October 2026). In inland villages, the home may fit better as a rural tourist home.

Can I open a new tourist home in Jaén?

Yes. This is the situation in the municipalities with the most activity:

What does Úbeda require?

Its Plan General treats the tourist home as a lodging use, and that brings two conditions:

  • Parking: one space for every three units (Boletín de la Provincia de Jaén, provincial gazette, no. 29 of 11 February 2022).
  • Historic centre: if the home is in a block of flats, it needs its own access, staircase and lift, separate from those of the rest of the building (gazette no. 113 of 13 June 2022). In practice, whole houses are a better fit in the historic centre.

And Baeza and Cazorla?

General rules. In Cazorla the town hall has presented a tourism coexistence plan which, according to its own press release, does not limit tourist homes, and it is negotiating an agreement with the Junta to carry out inspections. In Baeza, the Junta and the town hall discussed the tourist home regulations in July 2026 without announcing any measures.

Tourist home or rural house

Away from the coast and from towns of more than 20,000 inhabitants (that is, in most villages in the province), the home will normally be registered as a casa rural or vivienda turística de alojamiento rural (rural tourist accommodation), with its own rules (Decree 20/2002), and not as a vivienda de uso turístico (tourist home). Check this before you file anything: the procedure and the requirements are different.

What to check before you start

  1. That your municipality's urban plan allows tourist use in your home: Do I need an urban planning compatibility certificate? and Can my town hall suspend new tourist homes?.
  2. That your owners' association approves it by a three-fifths majority: Can my owners' association ban it?.
  3. That the home meets the Junta's requirements: requirements for the flat.
  4. Then, the registration: how the licence is processed.
