Renting your flat to tourists in Almería: what each municipality allows in 2026

In the province of Almería no town hall is recorded as having suspended or limited new tourist homes: not the capital, nor Roquetas, Mojácar, Níjar (Cabo de Gata), Vera, Carboneras or El Ejido. In short: as of 6 October 2026 no municipality in the province of Almería is recorded as having a municipal suspension or limit on new tourist homes. The common rules of Andalusia apply. The capital has a study proposing to close the zones that exceed 10 %, but it has not been approved.

Can I open a new tourist home in Almería?

Yes, under the general rules of the Junta and after checking with the town hall that its urban plan allows the use in your home.

A word on how we checked: the Boletín Oficial de la Provincia de Almería (provincial gazette) was not responding on the day of the review, so for this province we relied on the Junta de Andalucía, municipal websites and the press. None of these municipalities appears on the Junta's list of municipalities with limits. Before you invest, confirm it with your town hall's urban planning department.

What is being prepared?

  • Almería city. In 2025 the City Council published a study on tourist homes in the municipality that proposes not admitting new tourist homes in zones where they exceed 10 % of the dwellings; it has not been approved. In June 2025 it also signed an agreement with the Junta to carry out inspections (it does not limit anything). On 5 October 2026 it approved new building by-laws which, according to the press, regulate tourist apartments (a different category from tourist homes); we have not been able to check whether they affect tourist homes.
  • Níjar. In March 2025 the hotel employers' association asked the town hall to suspend new registrations; no agreement has been recorded.

Where do tourist homes weigh most?

Mojácar is the municipality in the province where they weigh most: more than 10 % of its dwellings are tourist homes (INE, May 2026). In Níjar it is almost 7 %. These are the kind of percentages that usually lead a town hall to set limits, as has happened elsewhere on the Andalusian coast: if your home qualifies, don't put it off.

What to check before you start

  1. That your municipality's urban plan allows tourist use in your home: Do I need an urban planning compatibility certificate? and Can my town hall suspend new tourist homes?.
  2. That your owners' association approves it by a three-fifths majority: Can my owners' association ban it?.
  3. That the home meets the Junta's requirements: requirements for the flat. Inland (the Alpujarra of Almería, Los Vélez, Tabernas), check whether yours is a rural tourist home, which has its own rules.
  4. Then, the registration: how the licence is processed.
