Renting your flat to tourists in Cádiz: what each municipality allows in 2026

Cádiz city and El Puerto de Santa María have suspended new tourist homes; Chiclana, only in the town centre; Jerez admits them on the ground floor and with a change of use. In Conil, Vejer, Tarifa, Barbate, Sanlúcar, Rota and Algeciras there is no recorded municipal limit. What to check before you start, with date and source.

In short: the province of Cádiz is the most divided in Andalusia. Cádiz city and El Puerto de Santa María have suspended new registrations of tourist homes; Chiclana, only in the town centre; and Jerez admits them with conditions (ground floor in blocks of flats and a municipal change of use). On the Costa de la Luz (Conil, Vejer, Tarifa, Barbate-Zahara), in Sanlúcar, Rota and Algeciras there is no published municipal limit as of 6 October 2026.

Cádiz city. Even before the suspension, the Plan General (amendment in force since October 2022) only allowed tourist homes in the historic centre in buildings with protection grades 0 and 1, and outside the old walls only on the ground, first and second floors. In 2025 the council plenary unanimously approved suspending the registration of new tourist homes throughout the city while the Plan is changed to make this permanent. The town hall is also preparing a by-law that is «as restrictive as possible».

El Puerto de Santa María. A year after the suspension, the town hall confirms that no new authorisations have been granted outside the transitional arrangements, and that the new plan, which will set which areas and which buildings allow tourist use, is still being drafted.

Chiclana. The suspension only affects the urban land zones «Conjunto Histórico» and «Ensanche Tradicional». There is an exception: a tourist home is allowed after a full refurbishment with a major works licence or in a new building in the Conjunto Histórico. The vast majority of Chiclana's tourist homes are in the coastal developments and the scattered rural areas, where there is no suspension.

And in Jerez?

Yes, they are admitted, with conditions, since publication in the Boletín de la Provincia (provincial gazette) of 22 January 2026 (final approval by the council plenary on 28 November 2025):

  • The tourist home becomes a lodging use: you must file with the town hall a declaración responsable (sworn statement) of change of use, in addition to registering with the Junta (on rural land, a licence).
  • In blocks of flats, only in ground-floor homes.
  • The home must meet the minimum dwelling size of Jerez's Plan General, which is larger than the Junta's, and the accessibility conditions for lodging.

The town hall also announced a by-law to distribute tourist homes by zone; as of 6 October 2026 it has not been approved.

And on the Costa de la Luz and elsewhere?

In these municipalities we have found no published municipal limit or suspension (BOJA, provincial gazette, the Junta's lists, municipal websites and 2025-2026 press). It is not a certificate: request planning information from the town hall before you start.

Conil and Tarifa are the municipalities in all of Andalusia where tourist homes weigh most: more than one in every eight dwellings. That is the kind of figure that leads a town hall to set limits, so if your home qualifies, don't put it off. In Sanlúcar, the town hall announced in November 2024 a change to its planning rules to limit use compatibility, with no known approval to date.

How many tourist homes are there?

According to the INE (Spanish National Statistics Institute), in May 2026: Conil 2,575, Tarifa 1,886, Chiclana 1,637, Cádiz city 1,471, Jerez 1,054 and El Puerto 1,013. The INE counts active listings on the platforms, not registrations in the Junta's registry: in El Puerto, for example, there are 1,855 registered (March 2026) compared with 1,013 listings. On the coast, between August and November between 7 % and 17 % of the supply is withdrawn from the platforms.

What to check before you start, wherever you are

  1. That your municipality's urban plan allows tourist use in your home: Do I need an urban planning compatibility certificate? and Can my town hall suspend new tourist homes?.
  2. That your owners' association approves it by a three-fifths majority: Can my owners' association ban it?.
  3. That the home meets the Junta's requirements: requirements for the flat.
  4. Then, the registration: how the licence is processed.
