How the result works

There are three filters, in this order: the municipality (whether it admits new registrations), the owners' association (by-laws and three-fifths agreement since April 2025) and the flat (14 built m² per place, bathrooms, climate control, safety). If one fails, the others do not matter. The map solves the first; the questionnaire, the other two.

Situation of each municipality as of 19 September 2026

Torremolinos: Admits new tourist homes. You can register the home if the owners' association approves it by three fifths and the flat meets the Junta's requirements. The trend along the whole coast is towards more control: better this year than next. More about Torremolinos →

Benalmádena: Admits new tourist homes. Homes are still being registered in 2026, with no moratorium or specific by-law. On 26 September 2024 the town hall presented a saturation map: tourist homes are 15.23 % of the total, with more concentration on the coast, the marina and Benalbeach (Arroyo de la Miel below 10 %, the Pueblo 5 %); no limits have been approved for now, but they could come in those areas. Fuengirola: Admits new tourist homes only with an independent entrance. Since 22 February 2024 the town hall applies art. 7.1.6 of its General Plan: a new tourist home must have access independent from the rest of the building (houses, terraced houses and ground floors with a door onto the street, yes; a flat in a block with a shared hall, no), and it asked the Junta to cancel about 600 registrations that did not comply. Málaga: Does not admit new tourist homes until at least August 2028. The town hall suspended new registrations across the whole city on 23 August 2025 (Decree-Law 1/2025, art. 6) and since 25 July 2026 the General Plan (amendment no. 28, initial approval) no longer admits lodging on residential land. Having your own entrance NO LONGER opens the door: that worked between June 2024 and August 2025. Homes already registered keep operating and can change holder.
