Documents the Junta de Andalucía asks for to register a tourist home

Nota simple, association certificate, operating title, power of attorney, residence registration if by rooms and the co-ownership annex. What each one is for and where to get it.

Short answer: besides the responsible declaration, the Junta asks for a nota simple from the Land Registry, a certificate from the owners' association approving tourist use, the title that allows you to operate the home if you are not the owner, a power of attorney if a representative signs, the residence registration certificate if you rent by rooms and the shared ownership annex if there are several owners.

And the first occupancy licence?

It is not attached, but you declare that the home has it. It is the municipal document stating that the building was built according to the works licence and is habitable. In old flats it sometimes cannot be found; the town hall's Urban Planning department can issue an equivalent certificate. If the home is non-conforming with planning, it cannot be registered without municipal authorisation.

Do I have to attach plans, photos or the insurance?

No. The Junta does not ask for plans, photos or insurance for registration. It asks you to declare that you meet the requirements; if there is an inspection, that is when you will have to prove it. That is why it is worth having the Cadastre's square metres to hand and a photo of the first-aid kit, the extinguisher and the detector: nobody asks for them today, but they are tomorrow's proof.

Is the energy performance certificate needed?

Yes, even though the Junta does not ask for it for registration. Royal Decree 390/2021 requires an energy performance certificate for "existing buildings or parts of buildings that are sold or let to a new tenant" (art. 3.1.b), and there is no exemption for short stays or tourist use: the list of exclusions (protected buildings, temporary, industrial, stand-alone under 50 m², to be demolished) does not include tourist homes. Article 16 also requires the energy label to appear in all advertising of the rental, including platform listings. It is done by a technician (architect, surveyor, engineer), costs between €60 and €150 and is valid for 10 years (5 if the rating is G). It is registered with the Junta de Andalucía.

What happens if a document is missing?

The declaration can be filed, but the Junta can require the missing documents and, if they are not provided, cancel the registration. The association certificate is the most often forgotten and the one causing most problems since 2025: without it, an association can demand the cessation of the activity and the Junta can deregister the home.

How long does it take to gather everything?

With the nota simple online and an owners' meeting already held, two or three days. Without the association's agreement, however long it takes to call the meeting: three weeks to three months. It is the critical step; we explain how to do it in How to ask your association for the vote.
